Foreign-related trademarks refer to foreign trademark owners applying for trademark registration in China, or trademark registration for export commodities in China. Where a trademark reciprocity agreement has been reached between the country of the foreign-related trademark applicant and China, the bilateral treaty shall be followed. According to the provisions of bilateral treaties, applicants are usually granted national treatment.
 
1. What materials are needed for foreign-related trademark applications?
 
A copy of the subject's qualification certificate. That is, legal proof documents that can prove the legal status of the trademark applicant in the country where it belongs, such as identity and nationality certificates.
 
The identity certificate of a foreign natural person is an ID card, a passport, and the regular residence certificate is a residence permit; the identity certificate of a natural person from Hong Kong and Macau is a passport or ID card, and the regular residence certificate is a mainland travel permit valid for more than one year; Passes to and from mainland China valid for more than the validity period. At the same time, the identification number should be marked after the Chinese name of the applicant.
 
Foreign enterprises follow the enterprise registration documents stipulated by the laws of enterprise registration in the country where they are located.
 
Attached are some other relevant certification materials, national trademark registration certificate, reciprocal agreement certificate, commodity list, etc.
 
Second, the foreign trademark application process
 
1. The name of the applicant should be exactly the same as the name on the legal certification documents (such as identity and nationality certificate) of the legal status of the country to which it belongs, and it cannot be changed arbitrarily;
 
If two or more applicants jointly apply for the registration of the same trademark, the name and address of the representative shall be entered in the name and address column of the applicant (if no representative is designated, the first person listed in the application form shall be the representative Person), and other joint applicants fill in the name on the additional page of the application form (no need to fill in the address).
 
2. The name and address of the applicant must be in both Chinese and English. If the name and address of the applicant are to be filled in English, the capitalization of English should be used. Applicants whose native language is not English must use both Chinese and English. In addition to other languages, you can also use their native languages. The order for the applicant's address (including Chinese and English) to fill in is: country (region) city (town) block and house number.
 
3. For foreign applicants who have registered trademarks for many times in China, the applicants' translation names should be the same. If the original registered trademark's owner name is inconsistent with the currently confirmed translation name, it should apply to the Trademark Office for the name change procedure. If the applicant is a natural person, the ID number must be filled in after the applicant's name, otherwise it will not be accepted.
 
3. Matters needing attention in foreign-related trademark applications
